[세무상담] 미성년 명의 재산취득…자금조사 대비해야 |

대전에서 벤처기업을 운영하는 A씨는 서울에서 대학교를 다니는 아들의 편의를 위해 4500만원짜리 작은 주택 한 채를 사 줬다.
그런데 3개월 후 국세청으로부터 자금출처조사대상자로 선정됐다며 '재산취득자금 출처에 대한 사전안내문'을 받았다. 국세청에서는 아들이 소유한 주택에 대한 소요자금의 출처를 제시하라고 요구했다.
A씨는 가까운 지인에게 자금조사출처대상자로 선정됐을 때 증여세를 추징 당하게 된다는 말을 듣고, 무엇을 어떻게 준비해야할 지 막막하기만 했다.
□ 30세 미만, 주택 5000만원 미만인 경우 자금출처조사대상 제외='자금출처조사'란 어떤 사람이 재산을 취득하거나 부채를 상환한 경우 그 사람의 직업ㆍ나이ㆍ소득세 납부실적ㆍ재산상태 등을 고려, 스스로의 힘으로 재산을 취득하거나 부채를 상환했다고 보기 어려운 경우 국세청이 소요자금 출처를 밝히는 것을 뜻한다.
당사자가 소요자금의 출처를 제시하지 못할 경우 국세청은 다른 사람으로부터 증여를 받은 것으로 인정, 증여세를 추징하게 된다.
자금출처조사는 모든 경우에 다 하는 것은 아니다. 특히 10년 이내의 재산 취득가액 또는 채무상환금액의 합계액이 일정한 금액(기준금액) 미만인 경우에는 자금출처조사를 하지 않는다.
자금출처조사가 배제되는 기준금액은 세대주인 경우 주택 2억원(30세 이상)∼4억원(40세 이상), 기타재산 5000만원(30세 이상)∼1억원(40세 이상), 채무상환 5000만원이며 세대주가 아닌 경우 1억원(30세 이상)∼2억원(40세 이상), 기타재산 5000만원(30세 이상)∼1억원(40세 이상), 채무상환 5000만원이다.
30세 미만인 경우에는 주택은 5000만원, 기타재산은 3000만원 미만이면 자금출처조사 대상에서 배제된다. 다만 기준금액 미만이더라도 증여라는 확실한 '물증'이 발견되면 즉시 증여세가 과세된다.
□ 자금출처조사, 어떻게 대비하면 될까?=자금출처조사 대상자에 선정된 사람이 증여세 과세를 피하기 위해서는 반드시 세무서에 관련 증빙서류를 제출하고 취득자금 출처를 밝혀야만 한다.
이 때 취득자금의 80%이상을 소명하지 못하면 취득자금에서 소명금액을 뺀 나머지를 증여 받은 것으로 보기 때문에 소명자료는 최대한 구비해 제출하는 것이 바람직하다.
특히 개인간의 금전거래의 경우에는 사적인 차용증, 계약서, 영수증 등만 가지고는 거래사실을 인정받기 어려우므로 이를 뒷받침할 수 있는 예금통장사본, 무통장입금증 등 금융거래 자료를 준비하는 것이 좋다.
